Terms of Service

The rules of the road for using Seek & Win: your rights, our responsibilities, and what happens if something goes wrong.

1. Purpose

These terms of service (the "Terms") govern the use of the Seek & Win platform, accessible via the mobile application and the website, operated by Seek & Win SAS.

2. Definitions

  • Platform: the Seek & Win mobile application and the associated website
  • User: any person using the Platform
  • Player: a User taking part in treasure hunts
  • Partner Venue: an establishment offering treasure hunts
  • Treasure hunt or session: a time-limited game held in a Partner Venue, during which Treasures and Coupons appear
  • Treasure: a virtual item tied to a Prize, which appears in augmented reality at a time and place inside the Partner Venue
  • Prize: a product supplied by a partner brand, put at stake in a hunt and handed to its winner
  • Coupon: a discount offer put at stake in a hunt, issued by a brand, by the Partner Venue or by one of its shops

3. Acceptance of the Terms

Use of the Platform implies full and unconditional acceptance of these Terms. If you do not accept these conditions, please do not use the Platform.

4. Registration and account

To access certain features, you must create an account by providing accurate and up-to-date information. You are responsible for keeping your credentials confidential and for all activity on your account.

You must be 18 or over to create an account and play. Your date of birth is asked for and checked at registration. An account whose date of birth is missing or shows an age under 18 cannot join a hunt or win a Treasure or a Coupon.

5. Use of the Platform

You agree to:

  • Use the Platform in accordance with applicable laws
  • Not cheat, manipulate, or circumvent the game mechanics, including falsifying your GPS position: automated anti-cheat checks detect location spoofing, and any proven fraud results in the cancellation of winnings and may lead to exclusion from the Platform
  • Not create fake accounts or impersonate others
  • Not disrupt the operation of the Platform
  • Comply with the specific rules of each Partner Venue
  • Not harass or harm other users

6. Hunt sessions, game rules, and prizes

Treasure-hunt sessions are organized with our Partner Venues and partner brands. Taking part in a session is free of charge, with no purchase required, and the app offers nothing to buy. Each session is governed by a game-rules document stating its dates, venue, the list of Prizes and Coupons at stake, their commercial value, and the per-player limits. These rules are available from the session page in the app.

During a session, Treasures and Coupons appear inside the Partner Venue, at times and places that are not announced in advance. The first player to find a Treasure wins it. A Coupon comes in several copies, until they run out. A session can therefore have several winners. Wins are recorded by our servers, whose decision is final. The Prize is collected at the Partner Venue's counter upon presentation of the win code, whose validity is limited in time. A Coupon is used at the counter or in the shop that issued it, under its own terms.

Prizes cannot be exchanged for money unless explicitly stated otherwise. Seek & Win is not responsible for the availability or quality of the Prizes and Coupons offered by brands, Partner Venues and their shops.

7. Geolocation and notifications

Playing requires access to your location, with your consent given on a dedicated screen in the app. Without this consent, you cannot join a hunt. Once you have joined a live hunt, the app sends your location in the background, including while your phone is locked, only while you are in or near the Partner Venue, and until the session ends or until you leave the hunt. Further away, background sending is paused. It is used to send you a notification when a Treasure or a Coupon appears near you, only inside the Partner Venue.

You can withdraw your consent at any time in the app (Settings → Location) or in your device settings, and turn off notifications the same way. Without notifications you can still play, but you are not alerted. These processing operations are detailed in the Privacy Policy.

If you turn on the Nearby Hunts alerts, the app saves your latest position and your phone's timezone, only while the app is open. These are used to send you a daily digest of the hunts near you and an alert when a session nearby is about to start. The Hunts near you section of the Privacy Policy explains what is kept, for how long and how to stop it.

8. Intellectual property

The Platform, its content, its design, and its features are protected by intellectual property rights. Any unauthorized reproduction, modification, or distribution is prohibited.

9. Liability

Seek & Win strives to ensure the availability of the Platform but does not guarantee uninterrupted operation. We are not responsible for:

  • Damages resulting from the use of the Platform
  • Content created by Partner Venues
  • Accidents occurring during treasure hunts
  • Loss of data or prizes

You use the Platform at your own risk. Be careful when moving around and observe safety rules.

10. Suspension and termination

We reserve the right to suspend or delete your account in the event of a violation of these Terms, without notice or compensation. You can delete your account at any time from the application settings.

11. Changes to the Terms

We may amend these Terms. Each new version is notified in the app, which asks you to accept it before you keep playing.

12. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, the courts of Paris shall have exclusive jurisdiction, unless otherwise required by law.
