1. Purpose
These terms of service (the "Terms") govern the use of the Seek & Win platform, accessible via the mobile application and the website, operated by Seek & Win SAS.
2. Definitions
- Platform: the Seek & Win mobile application and the associated website
- User: any person using the Platform
- Player: a User taking part in treasure hunts
- Partner Venue: an establishment offering treasure hunts
- Treasure hunt: a gamified course with objectives to complete
- Treasure: an item to find or an action to perform in a hunt
- Reward: a benefit obtained after completing a hunt
3. Acceptance of the Terms
Use of the Platform implies full and unconditional acceptance of these Terms. If you do not accept these conditions, please do not use the Platform.
4. Registration and account
To access certain features, you must create an account by providing accurate and up-to-date information. You are responsible for keeping your credentials confidential and for all activity on your account.
You must be at least 16 years old to create an account. Minors between 13 and 16 years old must obtain the authorization of their parents or legal guardians.
5. Use of the Platform
You agree to:
- Use the Platform in accordance with applicable laws
- Not cheat, manipulate, or circumvent the game mechanics
- Not create fake accounts or impersonate others
- Not disrupt the operation of the Platform
- Comply with the specific rules of each Partner Venue
- Not harass or harm other users
6. Treasure hunts and rewards
Treasure hunts are created by Partner Venues. The conditions of participation, the rules, and the rewards are defined by each Partner Venue.
Rewards cannot be exchanged for money unless explicitly stated otherwise. Seek & Win is not responsible for the availability or quality of the rewards offered by Partner Venues.
7. Geolocation
Certain features require access to your geographic location. You can disable this feature in your device settings, but doing so will limit your experience.
8. Intellectual property
The Platform, its content, its design, and its features are protected by intellectual property rights. Any unauthorized reproduction, modification, or distribution is prohibited.
9. Liability
Seek & Win strives to ensure the availability of the Platform but does not guarantee uninterrupted operation. We are not responsible for:
- Damages resulting from the use of the Platform
- Content created by Partner Venues
- Accidents occurring during treasure hunts
- Loss of data or rewards
You use the Platform at your own risk. Be careful when moving around and observe safety rules.
10. Suspension and termination
We reserve the right to suspend or delete your account in the event of a violation of these Terms, without notice or compensation. You can delete your account at any time from the application settings.
11. Changes to the Terms
We may amend these Terms at any time. Changes will be notified through the Platform. Continued use after notification constitutes acceptance of the new Terms.
12. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, the courts of Paris shall have exclusive jurisdiction, unless otherwise required by law.
